1.Introduction

Welcome to BeatMyPayment.com ("we," "our," or "us"). By accessing or using our website and services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

2.Service Description

BeatMyPayment.com is a marketing and consumer-connection service that introduces prospective homebuyers to independent, licensed loan officers and real estate professionals who compete for their business, and that identifies transactions which may qualify for a program covering up to 12 months of mortgage payments.

WE ARE NOT:

• A licensed mortgage lender, mortgage broker, or mortgage banker
• A real estate broker, brokerage, or real estate agent
• A financial advisor or credit counselor
• A loan originator, servicer, or funding source

We do not make loans, issue approvals or pre-approvals, negotiate loan terms, or provide financial, legal, or real estate advice. We connect consumers with independent, licensed professionals who are solely responsible for all offers, terms, approvals, and loan products.

3.No Lending Activity

BeatMyPayment.com does not originate, fund, underwrite, or service mortgage loans. We do not make lending decisions. All loans, mortgage products, and payment coverage programs are provided or administered by independent third parties. We have no control over their qualification criteria, approval processes, or lending terms.

4.Third-Party Relationships

When you submit information through our platform, you authorize us to share your information with participating lenders, loan officers, mortgage brokers, real estate agents, and program administrators ("Partner Providers"). These Partner Providers are independent entities, and we are not responsible for their actions, services, or decisions. A current list is published on our Authorized Partners page.

Referral Fees: We may receive compensation from Partner Providers when we refer users to them. This compensation does not affect your costs or terms with those providers. Our service is free to you.

5.No Guarantees

We make no guarantees, warranties, or representations regarding:

• Pre-qualification or loan approval outcomes
• That any offer you receive will beat your existing rate, terms, or monthly payment
• Eligibility for payment coverage, or the number of months or amounts covered
• Interest rates, loan terms, closing costs, or payment amounts
• Availability of any program, property, or Partner Provider at any given time
• Success in purchasing any particular home

"Beat your rate or payment" refers to the opportunity to receive competing offers; not all consumers will receive an offer that beats their existing terms. "Payment coverage" means qualified buyers do not pay the covered amounts out of pocket; coverage is provided through the structure of the qualifying transaction, is available only for transactions completed through program-participating professionals, and is subject to qualification, transaction type, and program terms. Not all applicants will qualify, and amounts vary. Borrowers remain responsible for their loan and all obligations under it.

Pre-qualification through our platform does NOT constitute a loan commitment, credit approval, offer of credit, or guarantee of financing. Nothing on this site is an offer of credit or a commitment to lend.

6.User Obligations

You agree to:

• Provide accurate, complete, and truthful information
• Independently verify all rates, payment amounts, coverage terms, and program details directly with the licensed professional or program administrator
• Comply with all applicable federal, state, and local laws
• Not use our services for fraudulent or unlawful purposes
• Understand that all financial decisions are your sole responsibility
• Consult with licensed professionals (lenders, attorneys, financial advisors) before making commitments

7.Eligibility

You must be at least 18 years old to use our services. By using our platform, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

8.Information Accuracy

All information on our website, including program descriptions, illustrations, and eligibility criteria, is provided for informational purposes only and may contain errors or be outdated. Any figures shown are illustrations based on the amounts you enter and are not offers, quotes, or estimates of credit terms. We do not warrant the accuracy, completeness, or reliability of any content. Always verify information directly with Partner Providers and official program sources.

9.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the greater of $100 or the amount you paid to us in the 12 months preceding the claim
• We are not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost opportunities, or emotional distress
• We are not responsible for the actions, services, or decisions of Partner Providers
• We are not liable for property defects, transaction disputes, or financing complications

10.Indemnification

You agree to indemnify, defend, and hold harmless BeatMyPayment.com and its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any law or third-party rights; or (d) your interactions with Partner Providers.

11.Intellectual Property

All content on BeatMyPayment.com, including text, graphics, logos, and software, is our property or that of our licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

12.Dispute Resolution & Arbitration

Any dispute arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. You waive your right to a jury trial and to participate in class action lawsuits.

The arbitration shall take place in the jurisdiction where our business is located, and the arbitrator's decision shall be final and binding.

13.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which our business operates, without regard to conflict of law principles.
